The mother had suffered a relapse of acute myelogenous leukemia; her physicians recommended a bone marrow transplant. Justice system reform is being implemented in Japan. The number of attorneys ( bengoshi ) has substantially increased and concerns have been raised about the impact on the profession's quality and ethics. The profession has called for a slowdown in the increase. Does the increase really adversely affect legal ethics in Japan? Should the pace of the reform be slowed down, from the perspective of maintaining legal ethics? This paper begins to answer these questions through empirical analysis of (1) whether (...) there is an increase in cases of ethical concerns; and (2) whether such an increase (if any) is caused by the increase in bengoshi . The paper then investigates whether there is an over-supply of bengoshi . It concludes with a discussion of the negative impact that a slowdown of the increase may have on access to justice and the bengoshi profession's (ethical) responsibilities. (shrink)

Projects that challenge students to practice service leadership for civic improvement can address the aim of developing civic-mindedness in undergraduates. We conducted two qualitative studies. First, we investigated the learning experiences of four teams of undergraduate business students, who undertook semester-long course-embedded service-learning projects in partnership with four Hong Kong-based social enterprises. The students described five modes of civic engagement as project purposes, mentioned applying six types of service leadership practice for civic improvement, and described eight types of developmental outcome (...) within the domain of civic-mindedness. Comparisons suggested that besides relational support through training and guidance, empowering infrastructure, opportunities to exercise autonomy, and opportunities to demonstrate competence, three project-related features that varied between projects were important in fostering civic-mindedness. These were direct contact with grassroots-based beneficiaries; the experience of making a tangible difference; and linking the campus with the wider community. A second qualitative study indicated that course-embedded team projects with these features that were undertaken in mixed teams that included freshman and senior year business students fostered civic-mindedness for both categories of student. Environmental eco-centrism, the claim that all members of the biosphere are ontologically and axiologically equal, presents a challenge to traditional ethical conceptions of the special status of humanity. Confucian and Kantian ethics approach this topic, and its application to other animals, in different ways: Confucianism employs stories that promote insight into the importance of sincerity and compassion to all animals, including non-human ones; Kant employs abstract reasoning to argue that non-human animals deserve respect because we humans share their basic nature. A large body of research links testosterone and cortisol to male-male competition. Yet, little work has explored acute steroid hormone responses to coalitional, physical competition during middle childhood. Here, we investigate testosterone, dehydroepiandrosterone, androstenedione, and cortisol release among ethnically Chinese boys in Hong Kong, aged 8–11 years, during a soccer match and an intrasquad soccer scrimmage, with 63 participants competing in both treatments. The soccer match and intrasquad soccer scrimmage represented out-group and in-group treatments, respectively. Results revealed that testosterone showed (...) no measurable change. DHEA increased during both treatments in the majority of participants and the degree of change had no relation to independent variables or covariate measures. Most boys experienced androstenedione increases during match play, but no significant differences during the intrasquad soccer scrimmage competitions. The magnitude of change differed significantly between treatments and was positively associated with age. These latter findings suggest boys’ androstenedione responses may be sensitive to competitor type. For most subjects, cortisol significantly increased during match play, decreased during the intrasquad soccer scrimmage, and differed significantly between treatments, suggesting each treatment promoted a different psychological state among competitors. Cortisol/DHEA molar ratio decreased during the intrasquad scrimmage, suggestive of a more relaxed mental state. These data shed new light on potential proximate mechanisms associated with coalitional competition among prepubescent boys, with relevance to adrenarche and life history theory. (shrink)

This research examines 5362 Instagram posts of five ethical fashion brands and shows that the presence of awe-inspiring visual elements increases consumer engagement on social media for ethical fashion brands. Further, this research identifies (...) the moderating roles of the color green and the size of the visual elements in this context. Two follow-up experiments provide causal evidence for these relationships. Experimental evidence for the role of deontological beliefs as a mediator of the relationship between feelings of awe and social media engagement with ethical fashion brands is also provided. This study examines the relationship between procedural justice and employee job insecurity, and the boundary conditions of this relationship. Drawing upon uncertainty management theory and ethical leadership research, we hypothesized that procedural justice is negatively related to job insecurity, and that this relationship is moderated by ethical leadership. We further predicted that the moderating relationship would be more pronounced among employees with a low power distance orientation. We tested our hypotheses using a sample of 381 workers in Macau and Southern (...) China. The results support all of our hypotheses. The implications of these results for research and practice are discussed. (shrink)

Since their introduction in the early 2000s, the use of social networking websites has exploded. Many businesses are seeing increased revenue due to their social commerce strategy. Despite the popularity of social commerce websites, some consumers are still hesitate to use them. This study aims to evaluate the factors that influence the adoption of social commerce. A sample of 721 Chinese We Chat users took part in the research. The findings reveal that social capital mediates the positive effect of social (...) commerce adoption and perceived ease of use on techno-stress and online impulse purchasing. Likewise, information overloading mediates the positive effect of social commerce adoption and PERU on techno-stress and online impulse purchasing. The findings have implications for both practice and research in understanding social commerce adoption in emerging economies. (shrink)

Dictatorial China contains vivid examples of grassroots deliberative democracy on issues vital to local participants. Three elements in our case studies are relevant to programs of deliberative, participatory decision making elsewhere in the world. First, the Chinese examples have all occurred within longstanding communities. Second, the members of these communities have faced concrete issues of a type they felt they had the knowledge to resolve. And third, all of these communities had access to institutional frameworks established from above that the (...) local populace could utilize as deliberative forums. In addition, a more distinctively Chinese factor was observed in two of our case studies: collective decisions were arrived at based on “moral economy” beliefs rooted in China’s socialist past. This paper suggests that liberal democratic governments adopt a reconciliatory approach to conscientious disobedience. Central to this approach is the view – independent of whether conscientious disobedience is always morally justified – that conscientious disobedience is normatively distinct from other criminal acts with similar effects, and such distinction is worthy of acknowledgment by public apparatus and actors. The prerogative applies to both civil and uncivil instances of disobedience, as defined and explored in the paper. Governments and courts ought to take (...) the normative distinction seriously and treat the conscientious disobedients in a more lenient way than they treat ordinary criminals. A comprehensive legislative scheme for governments to deal with prosecution, sentencing, and imprisonment of the conscientious disobedients will be proposed, with the normative and practical benefits of such an approach discussed in detail. This article examines how distrust drives exchange. We propose a theoretical framework integrating the literature of trust into cultural sociology and use a case of patients giving hongbao (red envelopes containing money) to doctors in China to examine how distrust drives different forms of unofficial exchange. Based on more than two years’ ethnography, we found that hongbao exchanges between Chinese patients and doctors were, ironically, bred by the public’s generalized distrust in doctors’ moral ethics. In the absence of institutional assurance, (...) Chinese patients drew on the cultural logic of particularism and its associated cultural repertoire to induce fidelity from their physicians. They mobilized interpersonal networks to function as assurance and presented hongbao as a return of favor to the doctors. This form of exchange is gifting-oriented. Alternatively, if there were no interpersonal networks to rely on, they proactively offered hongbao to doctors at arm’s length in an attempt to personalize the relationship to seek assurance and abate their anxieties. This form of exchange is bribery-oriented. Both forms of exchange co-existed when there was one-way generalized distrust manifested from patients to doctors. When doctors also developed generalized distrust in patients, arm’s length exchanges declined, leaving embedded exchanges as the dominant form. Our study asserts the central role of culture in constituting exchange behaviors and the importance of institutions in shaping the form of exchange. It contributes to the midrange theory of trust, generating a number of hypotheses for future research on the relationships among culture, institutions, distrust, assurance, and illicit exchange. In the debates on the roles of cultures in the ethics of human rights, one of them concerns Confucianism and Ubuntu, two prominent cultures in East Asia and Southern Africa, respectively. Some scholars assert that both cultures have values that are sharply different from the West, and conclude that the West should learn from these cultures. The aim of this paper is to philosophically investigate the roles of cultures in the ethics of human rights. I first introduce the works of (...) Bell, Metz and others on community values such as relationships and harmony in Confucianism and Ubuntu. I then argue that even if their interpretations were correct, their works still would not justify the conclusion they want. I show that it is better to use consequential evaluation rather than cultural evaluation to justify human rights. An example of human rights to health and privacy is discussed. This paper thus offers some preliminary but important philosophical investigations and addresses practical issues of consequential evaluation related to human rights. A kereszténység ezt felfokozta az erkölcsi cselekvése terén, míg a felvilágosodás a politikában tette mindenek feletti problémává a politikai tudást és eszményeket. Ezt az intellektualizált cselekvési eszményt azonban rendre kikezdik, és ezek a kihívást jelentő magyarázatok a romantikától a marxizmusig a valós cselekvésekre hivatkoznak, amelyek többé vagy (...) kevésbé eltérnek az eszménytől. Egy nemzedékkel ezelőtt, de még ma is sokak számára a valódi cselekvésmotívum az (osztály)érdek volt, míg a mai wokery a személyes érzéseket tette legitim és bármilyen cselekvést igazoló motívummá, míg az eszményeket az elnyomás eszközeinek tekinti, hiszen az eszményeket követni próbáló ember korlátozza önmagát. A kötet írásai a cselekvés szkeptikus megközelítését sugallják: a cselekvéseknek mindig sokféle motívuma lehet, valamilyen eszmény követésétől kezdve érdekek, szenvedélyek és érzelmek követéséig, és ezekről csak feltételezéseink lehetnek. A tapasztalatunk az, hogy a túlmoralizált politika ugyanúgy kellemetlen világot eredményez, mint az alulmoralizált. (shrink)

Exploring Practical Knowledge investigates professional practices from a hermeneutic perspective. The book presents, discusses and applies notions such as practical knowledge, practical wisdom, tacit knowledge, and normativity to the professional lifeworld. These contributions focus on both specific practices and more general questions concerning theories and investigations of practice. This volume comes as the result of a cooperation of three research centres: The two Centres for Practical Knowledge in Bodø, Norway and in Södertörn, Sweden, as well as the Research Group Value-Oriented (...) Professionalisation at the University of Applied Sciences in Utrecht, the Netherlands. It offers empirical studies of professionals as well as discussing the underlying theories, approaches and methods of exploring practical knowledge - including the limits to any articulation of these aspects of professional action. Richard Kirkendall's collection of essays, The Organization of American Historians and the Writing and Teaching of American History, examines the history of the Organization of American Historians from its founding to the present, using that history to illuminate how the writing of American history has changed over the last hundred years. The book provides coverage of all the major dimensions of the Mississippi Valley Historical Association's and the OAH's activities, ranging from the work of its scholarly publications, the Mississippi Historical (...) Valley Review and the Journal of American History, to its role in promoting the teaching of American history. Overall, the essays in the volume tell a story of the organization's progress toward greater inclusion and democracy, falling prey to a Whig interpretation of historiography. In doing so, the book is part of a larger tendency in the way that historians have approached historiography, which in turn reflects their ambivalence about their relationship to the historical process. Thus, even as the very enterprise of historiography is premised on the recognition of how historians are themselves the products of the historical process, historians have revealed the limits to that recognition in their approach to the subject. This essay shows how deeply rooted this duality has been in the study of American historiography and illuminates some of its sources by placing Kirkendall's book in the context of how the MVHA and the OAH have treated historiography over the course of the organization's history. This study provides a global perspective on citations of articles published in ten business ethics journals between 1999 and 2012 and establishes three findings. First, the results indicate that Journal of Business Ethics and Business and Society are the two top business ethics journals based on the distribution of normalized citations received. Second, although North America, particularly the US, remains the top producer of business ethics research, it has been surpassed by Europe in terms of weighted normalized research citations received (...) in 2012, implying a potential diminishing global role of US influence in business ethics research over time.
